Why I Continue to Be Loud About Female-Inclusivity Initiatives in Tech & Business

Over the last few months, I have grown increasingly loud about my support for initiatives that foster diversity and inclusion in tech & business. This has been especially true over the last couple months as I’ve watched what started out as Female Founder Office Hours culminate now in AllRaise.org. What I wanted to see grow and expand—a push from female VC’s like Megan Quinn, Aileen Lee, Jenny Lefcourt, Jess Lee, and their team members to bring more women into tech and foster a support system for them—has indeed now germinated into a force (and I can’t help but be amazed at what they & their allies have already accomplished in such a short period). I’ve written a response piece to AllRaise’s announced launch already, but sometimes one statement of support just isn’t enough.

I came into tech almost accidentally from the music world. That’s really my wheelhouse and one of the main industries I continue to build for and strive to impact. But lately, I’ve been running a thought experiment: is there theoretically anything that could make me walk away from music, even for a little bit?

Recently, I’ve come to the answer that yes, there is: diversity, inclusivity, and egalitarianism.

We’re at an inflection point now—the smart people realize that the future success of and in tech/business will be had by those who invite new perspectives and prize egalitarian dynamics. The future of the tech IPO no longer looks like a bunch of white guys huddled around a singular mindset. Now it looks exactly like Stitch Fix founder & CEO Katrina Lake holding her infant child ringing the bell to bring her company public—just as that picture was a metaphor for changing dynamics in tech, so too is an initiative like AllRaise key in helping usher in that new era of opportunities.

So if I sound excitedly determined, it’s because I am. Because the historian in me can discern that we’re at the beginning of a new cycle rife with possibilities to have a more diverse tech and business universe than we’ve ever had before.

At the end of the day, I will always be the first to make a music reference, and this just has Riot Grrrl punk written all over it. It’s brilliant and I am 100% behind it.

Allies for AllRaise.org

Given my somewhat short break from writing since January, I was wondering what my first post back would be on, and if it would be a lengthy assessment or a short burst.

Short burst it is.

I’ve been following (and championing) very closely the initiatives proposed and undertaken by the group of amazing women behind (first) Female Founder Office Hours, (then) Founders For Change, (followed by) Women in VC community events, and (now) AllRaise.org. Reading Aileen Lee‘s post from yesterday, it’s clear to me that even as painfully slow as it sometimes feels, change is indeed happening. I have sought and want to be a part of the change. And I know there are others like me who do as well.

I have tried to stay keenly aware of my inherent white guy privilege and use that to the benefit of others. I can only be what I am, but I get to determine how that helps others without the same afforded benefits. I can be an ally for the scores of women and underrepresented founders (POC, LGBT+, etc.) who aren’t afforded the same benefits of the doubt off the bat which they should be, and I can similarly use whatever position I have to push for more egalitarianism. And that’s what I try to do daily.

With the announcement of AllRaise.org and its focused initiatives, it is my hope that there is and will be room for the (white & male) allies out there like myself who want to be a part of this new evolution. I am excited to see where something like this can go. We are in the midst of a massive paradigm shift—one which is long overdue in creating a more level field of merit, diversity, and inclusivity. Consider this my name in the AllRaise hat.

I encourage my white and male counterparts out there to afford Aileen’s post and this initiative a heavy dose of retweets and attention; this is the new direction. Be the person who gives the shots to people who otherwise might not get them, and bring attention to the fact that there is clearly work to be done here. Take it from a history major: there is a right side and a wrong side of history—you want to be on the former, not the latter.

Retaining Our Conviction for Gender Equality

Perspectives from the Son of Two Civil Rights Lawyers

Last Saturday, on January 21st, 2017, women (and men) in all 50 states, as well as 50+ countries around the world, marched for gender equality. Their marches were a protest of the new American President Donald Trump, and his misogynist, exclusionary dialogue (monologue?) regarding gender rights in the U.S.

The marches were a resounding success, drawing more than 3 million people worldwide, and painting my social media feeds—and those of everyone I know—pink with solidarity. And for a moment—a day—it seemed that scores of people saw what I see every day.

My parents are civil rights attorneys—they have a combined 70+ years worth of experience practicing sexual harassment and employment discrimination law, and are barred (i.e. licensed to practice law) in 3 states. They’ve litigated at most levels, from state court all the way up to the 11th Circuit Court of Appeals on numerous occasions.

As a result, I grew up seeing the disgusting misogyny and sexism (not to mention racism, and most every other “-ism” you can think of) that so many people seemed intent on banishing last weekend. From the time I was in grade school, terms like “Title VII,” “Title IX,” and “EEOC” were words thrown around the dinner table as my parents discussed research for cases they were working on.

Now those words seem to be sinking into the consciousness of Americans on a much broader scale, and that in itself is a good thing. But it’s not the only thing, and we must not become complacent.

The reality is that as wonderful as marches are, they don’t achieve anything by their own virtue beyond creating awareness and emotion. How many people marched against the Vietnam War in the ‘70s? Millions. Did it force Nixon to pull out of Vietnam? No.

The power in marches and collective support is not in their ability to force legal changes—it is in their power to force lawmakers who otherwise would ignore the problems to pay attention and address those issues.

That is the understanding that we must have moving forward after last weekend. If we pat ourselves on the back, and simply drift back to where we were, then nothing changes; Trump is still President, the Congress is still hyper-Conservative, and women’s rights, minority rights, and LGBTQ rights are still in danger and under siege.

Change comes in conviction to speak out for others when there isn’t a big march to attend. It comes in the courage to hold people accountable for sexist policies and discriminatory laws, regardless of the size of the institution or the extent of their war-chest. The precedent for holding public policy-makers accountable is well-established:

  • Griggs v. Duke Power Co., 401 US 424 (1971) — Decided that certain education requirements and intelligence tests used as conditions of employment acted to exclude African-American job applicants, did not relate to job performance, and were prohibited.
  • McDonnell Douglas Corp. v. Green, 411 US 792 (1973) — Laid out a formula for a finding of discrimination where there is no admission.
  • Texas Department of Community Affairs v. Burdine, 450 US 248 (1981) — Laid out that the plaintiff always bears the burden of proof, and sets a finding of context for allegations of discrimination.
  • Meritor Savings Bank v. Vinson, 477 US 57 (1986) — Found that a claim of “hostile environment” sexual harassment is a form of sex discrimination that may be brought under Title VII of the Civil Rights Act of 1964.
  • Ellerth/Faragher v. City of Boca Raton, 524 US 775 (1998) — Decided that employers need to have an anti-harassment policy which is communicated/distributed to all employees, which tells employees who they can complain to if they are being harassed. Once a complaint has been received, the employer has the obligation to address the harassment claim, and take action if the complaint is founded.

And these are only a few of the cases which have become a part of Title VII and Title IX jurisprudence.

Thus it falls to us, in the days, weeks, and months after these marches to keep our focus clear. All the pink hats in the world and all the pictures of people gathered to march will mean nothing if no policy is affected by it.

If there continues to be the same gender-based wage-gap, diversity disparity, and dismissal of sexual harassment claims and grievances, we will have achieved nothing of consequence beyond snapping some great pictures for our social media.

The amazing thing is that it appears to me as if we really do live in a new era. It’s not 2002 anymore—LGBTQ rights matter to people (outside the LGBTQ community) on a scale they arguably never have before. Focus on sexual harassment and discrimination seems to be ticking up as ability to document and share these grievances has grown. More women and minorities serve in all facets of our lives than we’ve ever experienced—from politics, to business, to law, medicine, athletics, and the arts.

Now, the next step after making people aware, and care about these issues, is to make sure than something gets done. We’ve had the high of seeing that millions of people care, and were willing to brave the rain and cold to have their voices heard. We’ve seen that those people don’t just live in New York City and San Francisco, but live all over the country (and the world!)—in Boston, Atlanta, Houston, Anchorage, Miami, Chicago, Boise, Billings, Denver, and Philadelphia.

So with all of this in mind, let’s do something about it. Companies and universities should be actively seeking out attorneys with experience in discrimination and sex harassment law to coach their HR departments—to help them understand Title VII and Title IX, and set proper parameters for their employees based on these legal codes. More understanding and higher accountability means fewer cases, and fewer cases means less money that needs to be spent in litigation. And that’s not to mention the PR perks of high accountability and an egalitarian environment.

With all of the news this weekend regarding Trump’s new Muslim ban (that’s definitely coming up in another essay), it can be easy to forget the message which was loudly sent a week ago. But we need to keep pressure on the pulse of discrimination, and drive steadfastly towards gender equality if we’re ever going to fully achieve it. Egalitarianism and meritocracy are rights deserved by all, but it will take hard work to make it a reality.

Four Music Industry Posts Refocused

This week I threw a lot of notions and facts about the music industry out there, so I thought I would take a moment today to help refocus on them. Rather than write another post and add to the pile of important things to understand, I thought it better to simply restructure this past week’s posts in an easier, more digestible way of reading them. Here’s a short list for a few posts that went up this week, with a short description of each.

2. The Lie of “Live Won’t Save Music” – The wonderful adage of “Live won’t save music”—and why it’s a flat-out lie. The dynamics of the “live” factor in the music business (including the economic realities), and why “Live won’t save music” only applies to those artists and music professionals still grasping at the old, obsolete business model. An examination on how people need to restructure their thoughts on the music business if they want to be able to create a new, more lucrative business model.

3. Why Isn’t the Music Business Fully Crowdfunded? – Inspired by some things which I heard VC Fred Wilson postulate during the LAUNCH festival earlier this month. Discussions of the freedom that crowdfunding has allowed artists, and why it’s contributing to a trend towards staying independent. More than that, though, an examination of how artists can leverage the dynamic of crowdfunding for a better return in their own pockets.

4. Tell Me Again How There’s No Monopoly in the Music Industry – A simple chart that shows the incredibly monopolistic spiderweb of the major record labels and their subjects. With SONY in blue, Universal Music Group in green, and Warner Music Group in red, it’s not hard to see how three CEO’s (of these respective companies) essentially control all the music in the mainstream. If that’s not a monopoly, I really don’t know what is.

The Scourge of Sexism

With the issue of gender equality fast becoming one of the central topics in Silicon Valley (and by extension, the tech and startups industries) at the moment, I can’t say I’m anything but pleased. The problem of gender discrimination and the glass ceiling is long overdue for a solution. While I harbor no fantasies that such a solution will be found overnight, I am nonetheless pleased to see that there is a major effort being made to reform these shortcomings in the tech industry.

As a male, I can confidently say that gender discrimination hits very close to home for me; my parents both practice civil rights litigation, with a focus in employment discrimination and sexual harassment. I grew up seeing cases of blatant discrimination (and unfortunately it makes me angry to say I still do), where the the ugly beasts of intolerance and sexism were clearly visible. The latter, in particular, surprises me again and again because we are taught to believe that we’re moving forward in eradicating sexism—but not fast enough in my opinion. We still have a lot of work to do.

While the tech industry is starting to really spotlight and root out sexism within its ranks (as well it should), other industries are lagging too far behind in my opinion. The music industry, for example, is still too hampered by outright sexism for my taste, even after movements like third-wave feminism and Riot grrrl punk began to shatter the mold. It’s not a foregone conclusion by any means, and there are many within the music trenches who are trying very hard to change it for the better—to level the playing field so that gender becomes irrelevant—so that talent is acknowledged and validated by its inherent existence, regardless of the artist’s gender.

But let me provide two examples of what can be changed, and how people can step in to make the music arena more tolerant and progressive. Neither example makes me happy to share (less happy to have experienced), but perhaps that underscores their importance.

The Sleazy Promoter

The first example happened a couple of years ago, in the spring of 2013, and goes like this: I am good friends with a band whose members included a female element (the singer and drummer). The group was set to work with a promoter to book shows in their home state (which, though eliminated by name, I can say is quite a big market for independent music). The promoter made inappropriate and unwelcome advances towards the female band member(s) and the group cut ties, not wanting to work professionally with someone of such poor character quality. The promoter then retaliated by threatening to call every promoter within the state, seeking to destroy the group’s reputation, thus effectively cutting out their feet from under them. (In this particular state, I can say with confidence that there are at least seven major cities and/or scenes that they most likely split their time between).

I was in Amsterdam at the time, on my study abroad program. I woke up one day to a frantic “what do we do?? we’re going to get totally screwed by this person!” email from the singer. Even through text it wasn’t hard to clearly read her fear and anger over the situation. So her solution? Reach out to me in search of some advice.

The response I sent her was simple: I explained to her that I was behind her, and would throw the entire weight of my blog and radio show behind her and the band (and would bring in other artists I knew for support if need be). I even offered to write a letter as a professional contact (DJ and journalist) attesting to their quality as a band and professionalism as people, which they might use to send to anyone to rebuke the slanderous threats of this sleazy promoter. She seemed calmed by that offer (and most thankful, as you can imagine!) and we decided to see just how events would proceed.

In the end, the promoter never made good on his threats, and the whole situation seemed to blow over. But I never forgot that frantic email (I’m sure she hasn’t either), and to this day I’m still good friends with her and the band. The point is this: such a situation should never have occurred, and it very quickly seemed to spin out of control. But in situations like these, one needs to have the wherewithal to step up for what’s right. I didn’t do anything I didn’t think others wouldn’t do in the same situation. You don’t do it for pats on the back—you do it because it’s right.

The Sexist Tweeter

The second example happened more recently, during the Super Bowl this year. One of the Super Bowl commercials was to promote the hashtag #LikeAGirl to promote gender equality. This is one commercial I loved and supported, and I made so known on Twitter. This was the result:

I was actually staggered by the sheer sexism of the comment that I saw on my post. Someone telling me that I was sure to “get laid” for supporting “those feminists.” I was angry—actually I was seething. Not only had this person insulted the women that my comment was meant to support, but had dragged my name down too by insinuating that my motive was “to get laid.” I work with numerous artists—many of them with a female element—and I was pissed that this person had seen fit to insult not only people I work with, but people who are my friends.

The music industry is like the tech/startup industry in this respect—not perfect by any stretch of the imagination, but trying very hard to get better. And here was someone dragging us back to the dark ages. This is exactly the sort of thing that people in both industries (or any industry) need to find and root out. The people who make these comments and hold these views are toxic. It’s not (and won’t be) easy, but it has to be done. And it will be.

I for one will be on the lookout for it in the music industry, and will call anyone on it. I encourage other to take aim at sexism and gender discrimination in their respective industries which they know best. Music is my world, and I will not have it polluted with this sort of poison. Don’t step into my house and disrespect my business contacts and friends, it’s as simple as that.

Their Response Was Not a Fuckup; It Was Exactly Right

Just a few minutes ago, Product Hunt CEO Ryan Hoover posted a tweet and article on Medium acknowledging what he called a terrible fuckup; Product Hunt’s validation programming had made the erroneous assumption that all founders are male by using the article “his” when discussing validated identity.

The reaction from Hoover and Product Hunt to the tweet was exactly what it should have been: mortification at such a presumptuous error, speedy rectification of the problem, a personal apology to Allyson (the tweeter), and an immediate blog post owning up to the misstep for others to be mindful of. Frankly I would have been impressed by the first two things; but to see all this unfold in sequence in an expedited manner reaffirmed the reasons I use PH, and why I consider them an example of a company to emulate.

I have to give it up to the whole PH team; it’s not easy to admit a mistake, particularly when it’s brought to one’s attention in such a public arena. But they really went above and beyond in their response, and the subsequent Medium piece by Hoover really underscored their commitment to gender equality that I very much respect them for.

Well done PH, take a bow. We should all strive to be as good as this.
